On 6 March, the Court of Appeal of the Unified Patent Court issued, for the first time in the history of the European unified patent system, a referral for a preliminary ruling to the  Court of Justice of the European Union.
The upcoming rulings of the Court of Justice are particularly awaited, as they will clarify issues set to have a profound impact on the market strategies of non-EU manufacturers and on the organisation of their commercial supply chains. In particular, they will define the boundaries of the UPC’s cross-border jurisdiction and the scope of liability of authorised European representatives of companies based outside the EU.
