Newsletter - Milan Chamber of Arbitration: new rules in force as from 1 march 2019

The Chamber of Arbitration of Milan (CAM) published new rules which entered into force on 1 March 2019 and are applicable to the proceedings started from that date.

The main changes concern: the express obligation of the parties to act in compliance with the good faith principle and the power of the Arbitral Tribunal to sanction abusive behaviors (article 9), an express provision on arbitration on corporate law matters (article 17), the obligation of the parties to disclose third-party funding (article 43) and the introduction of emergency arbitration for interim or provisional measures (articles 44).
