With two recent rulings, the Italian Supreme Court has once again ruled on the fair compensation to be paid by employers to their employees for inventions developed by them. Considering these rulings, several interpretative profiles have been clarified regarding the regulation of the prerequisites of the fair compensation to be recognised to the employees/inventors, especially those relating to business inventions that the employer, or its successors in title, decides to use as trade secrets. These cases are very frequent and are often underestimated, and instead need to be precisely analysed in light of the applicable provisions.
