In its decision of 3 September 2025 in the Case T- 553/23, Philippe Latombe v EU Commission (“Latombe Decision”), the General Court of the EU dismissed the action for annulment of the adequacy decision related to the EU-U.S. Data Privacy Framework ("DPF"). This is the first decision by one of the EU's highest courts to confirm the legitimacy of the transatlantic data transfer regime, putting an end – at least for now – to the uncertainty that had accompanied the entry into force of the DPF.
