On 21 December 2023, the Court of Justice of the European Union ruled on the reference for a preliminary ruling made by the Juzgado de lo Mercantil de Madrid in the case against European Superleague Company, S.L. on the one hand, and UEFA and FIFA on the other. In particular, the EU Court assessed the compatibility of the rules on authorisation to organise new international football competitions, contained in the FIFA and UEFA Statutes, with competition law and the fundamental freedoms enshrined in the EU Treaties.
The judgment is destined to become one of the leading cases in European sports law, with possible significant implications for the future organisation and management of football competitions (and not only) at international and national level.
