Newsalert - CJEU rules on trademark law matters in the Sky v SkyKick case

On 29 January 2020, the Court of Justice of the European Union (“CJEU”) delivered a landmark decision in the Sky v SkyKick case (C-371/18). The decision stemmed from a referral of the English High Court of Justice on a trademark lawsuit filed by broadcasting provider Sky against IT and cloud provider SkyKick. 

Most notably, Sky claimed the use of the sign “SKYKICK” was infringing its EU trademarks on the word “SKY”, while SkyKick counterclaimed the invalidity of said trademarks since registered for goods and services that lacked a clear and precise indication (e.g., “computer software”) and applied in bad faith (i.e. with no intention to use them in relation to the goods and services they were registered for).
