The Firm represents clients in court proceedings in all ordinary and special Italian jurisdictions, most notably in civil, commercial, corporate, banking and financial disputes, but also in matters related to the Firm's other practice areas.
In the pre-litigation phase, the Firm's activity concentrates on facilitating client's informed decision-making based on, among other things, a thorough evaluation of the costs and benefits of the litigation process as compared to possible out-of-court solutions.
Advising financial markets operators in significant disputes often involving foreign clients requires strategic planning and co-ordination and the Firm pays particular attention to the organisational aspects of its advice, including in the due diligence and investigative phases of litigation. The Firm also has consolidated professional experience in the often very complicated implications of the contemporaneous applicability of different laws and conflicts of jurisdiction and law.
Studio Chiomenti advises clients in arbitration proceedings arising from various contractual structures both before the primary international arbitration institutions and on an ad hoc basis.
The Firm's professionals have consolidated experience in international commercial arbitration procedural issues enabling them to assist in even the most complex disputes. Such knowledge extends to foreign arbitration tribunals and disputes subject to foreign law.
The practice, principles and legal concepts of various legal frameworks, primarily those of common law jurisdictions, are frequently applied in international commercial arbitrations and the Firm has professionals who are qualified to practice in, have foreign degrees from, and relevant work experience in, such jurisdictions.
Studio Chiomenti has significant experience in foreign investment related arbitration, primarily in the handling of high value disputes before the special arbitration boards instituted pursuant to the 1965 Convention on the Settlement of Investment Disputes between States and Nationals of other States, better known as the ICSID Convention.
The Firm's arbitration practice extends to all primary investment sectors, particularly, energy, the sourcing, distribution and maintenance of natural resources, large construction and reclamation projects, and heavy machinery supply.
The Firm has also gained experience in foreign investment disputes arising under international treaties, particularly bilateral and multilateral agreements for the promotion and protection of foreign investments.
